Channel Zero respects
the privacy of its users and is committed to protecting such privacy in
accordance with this Privacy Policy. This Privacy Policy explains Channel Zero
Inc.’s and its subsidiaries’, affiliatesÂ’, related companiesÂ’ and armÂ’s l
gth
companiesÂ’ (collectively, “Channel Zero”) treatment of you
personally identifiable information collected in connection with your
activities on or related to all Channel Zero websites, applications, and platforms
including, for example, CH-CHing! and Parrot TV, (the “Channel Zero
Sites”), all services and business purposes of Channel Zero, and all
services made available on the Channel Zero Sites (collectively, unless noted
otherwise, the “Channel Zero Services”). This Privacy Policy also
explains how you can ask questions and make suggestions about our privacy
practices and review and update your personal information.
Channel Zero will continue to review the
Privacy Policy on an ongoing basis to ensure that it remains current with
evolving technologies and the needs of Channel Zero, its customers, its employees
and the public at large. Please
note that this Privacy Policy does not apply to the practices of companies or
websites or applications which are not owned or controlled by Channel Zero.
In obtaining your consent to collect information, we seek
to advise you of the identified purposes for which Personal Information will be
used or disclosed, and describe the identified purposes in a manner that is
easy to understand.
Collection and Use
of Personal Information
In the course of
operating the Channel Zero Services, we may collect two types of information
about our users: Personal Information and Non-Personal Information.
“Personal Information”
is personally identifiable information, such as your name, address, email
address, birth date and gender. Personal Information is collected by us when
you choose to provide it to us when registering for a Channel Zero Service,
such as when you choose to subscribe to a Channel Zero Service, received an
invitation from Channel Zero to participate in an event or promotion, enter a
Channel Zero promotion, participate in a Channel Zero event, or choose to
receive a Channel Zero newsletter. In addition, if you choose to contact any of
our customer service representatives, we may keep a record of that
correspondence so that we may fully address the subject matter. We may also
receive Personal Information from our business partners and other third parties,
provided that such third parties confirm to us that you have permitted them to
share such information.
Business contact
information such as the name, title, business address, email address or
telephone number of a business or professional person or an employee of an
organization is not considered Personal Information.
“Non-Personal
Information” is information of an anonymous nature, such as your Internet
Protocol Address (IP Address), the domain you may have used to access a Channel
Zero Service, the type and version of browser or operating system you may be
using, and the website you may have come from and visit next. Aggregate
information, such as demographic statistics of our users (e.g. average age or
geographical allocation of our users), number of visitors and average time
spent on a Channel Zero Service, is also considered Non-Personal Information.
Non-Personal
Information is collected or derived by us in the course of operating the
Channel Zero Services. For example, our Web servers may automatically collect
Non-Personal Information which is provided through your browser or stored on a cookie
or through a web beacon when you choose to use a Channel Zero Service.
Channel Zero may share Non-Personal
information with advertisers and service providers that
perform advertising-related services, as well as our business
partners in order to tailor advertisements, measure and improve advertising
effectiveness, and enable other enhancements. This information includes your
use of the Channel Zero Site or Channel Zero Services, websites you visited,
advertisements you viewed, and other activities using while using the Channel
Zero Services.
Channel Zero may ask for Personal
Information only for the following purposes:

To establish and maintain a
responsible commercial relationship;
b)
To allow us to provide ongoing
services and support;
c)
To bill for, and collect
payment for, Channel Zero Services and products;
d)
To manage, develop, and market Channel
ZeroÂ’s network, business and operations;
e)
For the establishment,
management or termination of an employment relationship;
f)
To meet legal and regulatory
requirements;
g)
To obtain credit information or
provide it to others; and
h)
For any other purpose with
explicit consent.
Consent
Channel Zero obtains your consent for the
collection, use or disclosure of Personal Information, except in limited
circumstances described below. There are a number of ways in which you may
provide us with and consent to our collection of certain information, some of
which may include Personal Information. However, if you choose not to provide
certain information, certain features of the Channel Zero Services may not be
available to you and some features may not function properly.
Channel Zero will seek consent to use and
disclose Personal Information at the same time it collects the information. In
general, implied consent for Channel Zero to collect, use and disclose Personal
Information for all identified purposes is obtained in the following
circumstances: (1) when you apply for Channel Zero Services or products; (2)
when you use Channel Zero Services or products; (3) when an individual submits
an application for employment with Channel Zero or (4) for the establishment,
management or termination of an employment relationship. There may be times
when Channel Zero may seek consent to use and disclose Personal Information
after it has been collected, but before it is used or disclosed for a new
purpose.
Channel Zero may collect, use or disclose
Personal Information without knowledge or consent only in the following,
exceptional circumstances:
a)
Where it is clearly in the
interests of the individual and consent cannot be obtained in a timely way,
such as when the individual is a minor, seriously ill or mentally
incapacitated;
b)
Where it is in relation to the
investigation of a breach of an agreement;
c)
Where it is necessary to
assess, process or settle an insurance claim;
d)
Where it is to a lawyer
representing Channel Zero;
e)
In the context of a prospective
business transaction;
f)
Where it is to collect a debt;
g)
Where it is to comply with a
subpoena, warrant or other court order;
h)
Where it is produced by an employee
in the course of their employment and the collection, use or disclosure is
consistent with the purposes for which the information was produced;
i)
Where it is for any other
purpose otherwise required by law; or
j)
In the case of an emergency
where the life, health or security of an individual is threatened; and
k)
where it would be reasonable to
expect that disclosure with the knowledge or consent of an individual would
compromise the investigation or the ability to prevent, detect or suppress the
fraud,
a.
for the purposes of
investigating a breach of an agreement or contravention of a law that has been,
is being or is about to be committed; or
b.
detecting or suppressing fraud
or of preventing fraud that is likely to be committed.
You may withdraw or vary consent at any
time, subject to legal or contractual restrictions and reasonable notice. If
your Personal Information is necessary to provide you with the products or
services you requested or the safety and security of our network, the withdrawal
of consent will terminate your relationship with us. Please contact us at the

Disclosure and Retention of Personal
Information
We will not sell or
rent your Personal Information to anyone. We will only disclose your Personal
Information to third parties:

Where you
have specifically given us your consent to disclose your Personal Information
for a designated purpose;
b)
Who are
acting on our behalf as our agents, suppliers or service providers, solely to
enable us to more efficiently provide you with the Channel Zero Services. Such
entities act under strict contractual controls, requiring them to maintain the
confidentiality of all such Personal Information and to use such information
solely for purposes related to the provision of the Channel Zero Services;
c)
As may be
set out in the Terms and Conditions applicable to a Channel Zero Service, to
facilitate the provision of such Channel Zero Service, such as fulfilling legal
requirements;
d)
As
required by law, including by an order of any court, institution or body with
jurisdiction or authority to compel the production of information, or in order
to protect or defend a legal interest; or
e)
In connection
with a Channel Zero corporate re-organization, merger or amalgamation with
another entity, or a sale of all or a substantial portion of the assets of
Channel Zero provided that the Personal Information disclosed continues to be
used for the purposes permitted by this Privacy Policy by the entity acquiring
the information
From time to time, we may allow you to use
our Services with social networking services and connect your account with
accounts that you have with third parties including with certain third-party
social networks. If you choose to share information about your activities
with third-party accounts, then Channel Zero may send information
about you to such third parties.
Internally, only Channel Zero employees
with a business need to know, or whose duties reasonably so require, are
granted access to Personal Information.
Channel Zero maintains best practices for
information and records retention and destruction which apply to Personal
Information that is no longer necessary or relevant for the identified purposes
or required by law to be retained. Such information is destroyed, erased or
made anonymous within a reasonable period of time after Channel Zero no longer
reasonably requires the Personal Information for legal or business purposes.
Security and Safeguarding of your
Personal Information
The security of your
Personal Information is important to us. Channel Zero takes technical,
contractual, administrative, and physical security steps to protect Personal
Information that you provide to us. We instruct our employees with access to
your Personal Information that it is to be used only in adherence with the
principles set forth in this Privacy Policy and the laws applicable to each
specific business.
In certain areas, such
as when you provide credit card information to us, we work to help protect the
security of your credit card information during transmission by using industry
standard encryption technology.
You can help protect
the security of your Personal Information as well. For instance, never give out
your password, since this is what is used to access your account or
registration information. Also remember to log out of your account and close
your browser window when you finish using a Channel Zero Service or surfing the
Web, so that other people using the same computer won’t have access to your
information. Unfortunately, however, no database or data transmission over the
internet can be guaranteed to be 100% secure. As a result, while we strive to
protect your Personal Information and privacy, we cannot guarantee or warrant
the security of any information you disclose or transmit to us online and
cannot be responsible for the theft, destruction or inadvertent disclosure of
your Personal Information. Consequently, Channel Zero, its affiliates, related
companies and armÂ’s length companies and any directors, officers, employees
agents, contractors, subcontractors or agents of the foregoing do not
represent, warrant or guarantee that your Personal Information will be
protected against misuse, loss or modification, nor do such parties accept
liability for the security of a userÂ’s Personal Information submitted on or
in
connection with the Channel Zero Sites and Channel Zero Services.
We are committed to
protecting the privacy of children and we do not knowingly solicit personal
information from children under the age of 13. If a child has already provided
us with personal information, his or her parent or guardian may contact us for
the purpose of deleting this information.
Individual Access and Accuracy
Channel Zero provides
you with the means to access, update, edit or delete any account or
registration information you may have provided to us at any time on your own by
going to the appropriate page in the account or registration section of the
relevant Channel Zero Service, and changing or deleting such information as
desired.
If you are unsure
whether we have a record containing any of your Personal Information and would
like to confirm whether or not we do, please send an e-mail indicating all
e-mail addresses that you may have given us.
If you decide at any
time that you do not want to receive any e-mail materials to which you have
subscribed, you may choose to unsubscribe to these e-mails by following the
instructions at the end of the message.
